By using the Site, opening an account, or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service, Quickgineer Payment Terms, found here (“Payment Terms”), Quickgineer’s Community Standards, found here, and any additional standards, conditions, policies, guidelines, and in-product disclosures (collectively, the “Terms”), which are incorporated herein by reference. You further acknowledge, you have read and understood our Privacy Policy, found here. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Site. 1. Representations and Warranties

This Site is offered and available to users who are at least 18 years of age and of legal age to form a binding contract. If you are under 18 and at least 13 years of age, you are only permitted to use the Site through an account owned by a parent or legal guardian with their appropriate permission. If you are under 13 you are not permitted to use the Site or the Quickgineer services.

By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

2. Overview (Main terms, in a nutshell)

• Only registered users may request projects on Quickgineer. In registering for an account, you agree to provide us with accurate, complete and updated information regarding your business or personal details, and update such details as required, without undue delay. In addition, you must not create an account for fraudulent or misleading purposes. You are solely responsible for any activity on your account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.
• Quickgineer determines their pricing, at their sole discretion.
• Users pay Quickgineer in advance to create an Order, as further detailed on the Payment Terms.
• For fees and payments please read the Payment Terms.
• When purchasing on Quickgineer, Clients are granted all rights for the delivered work.
• Quickgineer retains the right to use all delivered work that the user has agreed to include and is published as part of a review, and Content for Quickgineer marketing and promotion purposes.

3. Clients/Users

3.1 Basics

• You may not offer direct payments using payment systems outside of the Quickgineer platform.
• Quickgineer retains the right to use all delivered work that the user has agreed to include and is published as part of a review, and Content for Quickgineer marketing and promotion purposes.
• When placing an Order on the Quickgineer platform you may only use funds that were obtained from legal sources and are not, directly or indirectly, connected to any unlawful or fraudulent activities.

3.2 Purchasing

• Please refer to the Payment Terms for making payments through the Site and to learn about fees and taxes.
• You may not offer to pay, or make payment using any method other than through the Quickgineer.com site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support here.

4. Orders

4.1 Basics

• Once payment is confirmed, your Order will be created.
• An Order is marked as Complete after it is marked as “Delivered” and then accepted by a Client. An Order will be automatically marked as “Complete” if not accepted and no request for modification was submitted within 3 days after the Order was marked as “Delivered”. The Client may extend such period by up to 5 additional days.
• A milestone (on an Order with milestones) is marked as “Complete” after it is delivered by Quickgineer and then accepted by the Client. A milestone will be automatically marked as “Complete” if no acceptance or request for modification were submitted within 3 days after being marked as Delivered, however, in such case the Order will stop and all further milestones will not start. Once a milestone is delivered and accepted, Client may choose to either continue with the Order and pay for the next milestone, or to stop the Order.

4.2 Handling Orders

• Quickgineer is required to meet the delivery time they specified when creating their Custom Offer. Failing to do so will allow the Client to cancel the Order when an Order is marked as late.
• Users are responsible for scanning all transferred files for viruses and malware. Quickgineer will not be held responsible for any damages which might occur due to site usage, use of content or files transferred.
• Clients may use the "Request Revisions" feature located on the Order Page while an Order is marked as Delivered if the delivered materials do not match the requirements sent to Quickgineer at the beginning of the Order process.

5. User Conduct and Protection

Quickgineer fosters a professional and community-driven environment. Users should uphold this spirit in all interactions on the Site. For reporting violations or account issues, contact our Customer Support team.

5.1 Basics

• Contact Details: Do not request or provide personal contact details to communicate outside of Quickgineer.
• Information Exchange: Any necessary personal information must be shared within the Order Page.
• Site Protection: Quickgineer is not responsible for interactions outside the Site.
• Conduct: All exchanges must occur on the Site. Rude, abusive, or threatening language is prohibited and may result in warnings or account suspension.
• Non-Discrimination: Do not discriminate against users based on gender, race, age, religion, or sexual orientation. Violations may lead to account suspension.

5.2 Orders

• Solicitation: Do not spam or solicit previous clients to modify reviews or cancel Orders in violation of our policies.

5.3 Violations

• Warnings: Users may receive warnings via email or on the Site for violations or misconduct.
• Actions: If we act against your account, we will email you the reasons and options for review. Refer to the Notices and Appeals section for more information.

Non-Permitted Usage

• Adult Content: Adult-oriented or pornographic materials are prohibited.
• Behavior: Communication must be friendly and professional. Bullying, harassment, and hate speech are not tolerated.
• Privacy: Do not post others' private information. Personal information should only be exchanged on the Order Page. We do not use client information beyond delivery of work.
• Profile Accuracy: Do not create false identities or impersonate others. Your profile should be accurate and represent your true identity.

6. Cancellation and Refunds

All cancellations and refunds must be handled according to our Cancellation Policy. Review the terms for cancellations and refunds related to your Orders and account.

7. Intellectual Property Rights

• Content Ownership: Users maintain ownership of their intellectual property. By using the Site, you grant Quickgineer a non-exclusive, royalty-free license to use, display, and distribute your content.
• Infringement: Do not use the Site to infringe on others' intellectual property rights. Quickgineer will take action to address infringement claims as outlined in our policies.

8. Limitation of Liability

Quickgineer is not liable for any indirect, incidental, special, or consequential damages arising out of the use of the Site or related services. Our liability is limited to the maximum extent permitted by law.

9. Changes to the Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. It is your responsibility to review the Terms periodically.
